I. Participant, Parent, and Observer Release Statement and Agreement
We, the undersigned ("attendee”, “participant", “parent”, “observer” herein), hereby release and hold harmless ARTS International and The Applause Rising Talent Showcase, both divisions of Applause International Model and Talent Development, Inc., ("ARTS" herein), my Regional Director, and any and all of their owners, employees, agents, contractors, or assigns from any and all liability for personal injury, illness, death, property damage or loss, which may arise during or consequent to travel to or from, or participation in and/or attendance at the Showcase, and agree not to make a claim against ARTS with respect to any such injury, illness, death, damage, or loss. Also, I fully understand that there is an inherent risk of exposure to COVID-19 in any public place where people are present and that COVID-19 is an extremely contagious disease that can lead to serious illness and death; by attending this event I voluntarily assume all risks related to exposure to COVID-19. I understand, agree, and acknowledge that ARTS will not be held liable for, or in any way responsible for, forces of nature, including, but not limited to, weather, labor disruptions, war, terrorism, acts of government regulation, hotel breakdowns, or any similar unforeseen event which may postpone or prevent my participation in the event. If any such unforeseen event prevents my partial or full attendance in ARTS, I understand, agree, and acknowledge that I will not be entitled to a refund. However, I will be entitled to attend the next consecutive event (or the part of the event I missed), without paying any additional fees to ARTS. I also hereby allow my name, photographs, or video images to be used in any present or future publications, broadcasts, or promotions by ARTS or its assigns, although not for any other purpose, for no compensation, and ARTS may edit and process such for use, in whole or in part, in any medium, at its sole discretion.
I agree to act responsibly and with decorum while a guest of ARTS and the hotel, and agree to indemnify and hold harmless ARTS from any claims or actions brought by the hotel or any person at the event, which may arise from my conduct or participation, including but not limited to claims or lawsuits for personal injury, death, or property loss or damage.
I further agree to be dismissed from ARTS and leave the hotel without refund, if I, or any member of my family, or others who accompany me are found to be involved or intoxicated with drugs or alcohol, or engaged in misconduct which may harm people or property or hinder other participants from the full participation and enjoyment of the event, or misconduct which is disruptive to the ARTS Owners, Directors, or Staff. I hereby agree that the ARTS Owners are the final determinants of these matters.
I warrant and represent that I am legally free and able to attend ARTS, and that I have no contractual obligations preventing my attendance. I expressly agree to release and hold harmless ARTS from any claims, now known or unknown, resulting from my breach of any of my warranties set forth herein, and hereby indemnify ARTS, including costs and attorney's fees, for defending and/or paying any claim made which is adverse to the warranties and representations made herein.
II. Participant or Participant’s Parents Only Release Statement and Agreement
I acknowledge that I have received a copy of, read, understand, and will abide by the "Rules and Regulations" and refund policies of ARTS as detailed in the ARTS Participant’s Manual. I understand that all determinations of performance rules are final. I agree that ARTS cannot guarantee me callbacks or a contract, as my success is dependent on many factors beyond its control. I also understand that it is in my best interest and for my protection not to enter into a contract or agreement with any Agent present without proper guidance and due diligence. I also understand that it is in my best interest and for my protection not to enter into any private conversations with agents during or after the showcase without completely involving my parents (where applicable), Regional Director, or ARTS owners/representatives; this includes emails, text messages, phone calls, and all social networking/media platforms (i.e., Facebook, Twitter, Instagram, Snapchat, Skype, etc.).
I also understand that earnings in the acting and entertainment industries are speculative, and no representative of ARTS or my Regional Director has made any representation or warranty concerning the amount of such earnings in order to induce me to attend the event. I will not hold ARTS liable for any lost earnings that I may not realize from my participation in these industries.
I hereby agree and understand that the ARTS Regional Director, my Local Agent, represents me officially at the ARTS. My Director hereby agrees to assist and advise me now and in the future in all matters pertaining to a modeling and talent career: grooming, education, pictures or portfolio development, and, most importantly, representation to the most qualified Agents, Managers, and Casting Directors in the world. By attending ARTS, I understand that my Regional Director will be representing me as my Mother Agent.
By checking the box, I verify that I am the parent or legal guardian of the participant(s) named on the official ticket through HomeTown, and I have authority to enter into this agreement on their behalf and I agree to be bound by the terms and conditions of the above statement and agreement for the ARTS event December 6-11, 2022 in Burbank, CA.
